Did Trump Campaign cut ties with Sidney Powell?

NO! That’s what the media wants you to believe. The statement by Giuliani was issued to clarify things.

Clarify What?

What the statement did was clarify that she was not a part of the Trump Campaign Legal Team. The former prosecutor is still there and still in take-no prisoners mode as she continues to pursue illicit voter fraud. What they did was simply state the existing relationship as her being independent of the Legal Team.

Why?

I can thing of at least two reasons.

The first reason is to clear up any misunderstandings people may have. Some apparently thought she was part of the Legal Team rather than a lawyer acting in conjunction with but not part of the team.

Secondly, there is the matter of fundraising. I got the impression that she has her own fundraising site, and they are simply making sure the lines are clear.

A third reason may be that she wants to remain independent. Her focus is on voter fraud while the Legal Team could be broader. This is just a guess on my part, but it makes sense.

Do They Still Stand with Her?

I will let you decide.

Other than the clarification, there has been no disavowal of any of her charges or statements. In fact, the Federal Election Commission chairman seams to be echoing them. The fact that he and others are supporting the challenges is a testament to the seriousness of the charges and the confidence they have in the evidence. My personal opinion is that yes, they still stand with her.

What happens Next?

So far, everything seems to be going as expected. I’m not a lawyer, but it seems logical to think that there needs to be a legal trail to the Supreme Court where I think this will all end up. So, it was necessary to go through the lower courts (state courts) which are generally liberal. The Trump Team knew that these courts would take a liberal stand and their expectations were verified.

It looks to me like these cases will soon be in the lower Federal courts and begin working their way upward to the Supreme Court where the majority take a serious view of the U.S. Constitution and will likely take the case. Because of the seriousness and limited time, the Court would also need to prioritize the case.

Meanwhile there are still other opportunities for President Trump to win.

Opportunities

According to Alan Dershowitz, a Harvard Law professor emeritus, there are at least three avenues that the President can get re-elected by. These are:

  1. In Pennsylvania, the courts changed what the state legislature, which the U.S. constitution has given ultimate authority regarding Presidential elections, can do about counting ballots. He thinks this is a winning issue before the Supreme Court.
  2. The second path or argument is called the ‘equal protection’ of voters. In this case, some Pennsylvania counties allowed flawed ballots to be cured where others did not.
  3. The third path has already been mentioned and that is the computers and/or software, either fraudulently or by glitches, literally changed thousands of votes.

Without legal expertise I can only guess, but in my opinion, it is possible that the path is not limited to just one. It appears to me that all three paths could be used.

There is still a way to go, but that covers the existing paths as far as I know. Meanwhile the news media continue to confuse the public by calling Joe Biden the President-Elect. The truth is there is no President-Elect until the government makes that determination. It is never the news media; their declaration is just informative and not official.

This means that President Trump is under no obligation to concede to Biden nor is Biden in any way a legal representative of the government. This also means Joe Biden is not eligible to receive transition money. If he is ever officially called the winner, then he can receive the money.

Welcome to Riddle News. This is a Special review of the 2020 election.

Do you Remember the Debates?

I do. And if my memory serves me right the Democrats continually said that Trump would not accept election results even though there was no evidence supporting that charge. Isn’t it odd that the prophecy came true?

Do you suppose the Democrats knew something we didn’t know?

Think about it. Evidence is piling up that a major effort to steal the election has been uncovered. When you are talking about thousands and tens of thousands of votes, that tells me that the Democrats had or were already developing these ballot dumps or whatever they are called.

If that was so, then they knew that the irregularities would show up. But it appears that they did not consider the legal challenges available to the Republicans. Either that or they were so desperate to get rid of Trump that they were willing to risk getting caught! I think it was the latter and they did get caught. And now we have a mess on our hands.

But surely they had to know they’d get caught.

Do criminals think they are going to get caught? No. They are too smart to get caught – until they do. Politicians of both parties often think that way. And when these politicians don’t believe in absolutes like sin, they get to define what is right and wrong. In this case, they believe that whatever it takes to get rid of President Trump is right.

Was the Media involved?

It wasn’t necessary back prior to the debates or when the debates started, and they certainly wouldn’t admit it now. But any reporter worth his or her salt should have noticed the irregularities and impossibilities of Biden’s sudden overnight surge. Especially when the counts for Biden were so unusually high and statistically unbelievable.

However, the media is certainly involved now. A real reporter would start digging if there was the slightest hint of wrongdoing. There is more here than a mere hint, yet the media either ignores it or dismisses it with their famous, “no evidence”.

What will the courts do?

I don’t have a great deal of confidence in the state courts. In many states these are partisan, and in the states where the irregularities are showing up the courts tend to be Democratic. At the same time, it is important to file in the state courts to create a judicial path that can be shown in the higher courts, meaning federal courts.

Many of the nations federal courts have conservative or, better yet, constitutionalist judges. These are judges who will go by what the constitution says, not Pelosi’s version of the constitution, but the one our forefathers wrote. And that being the case, we can expect such voter fraud to be discovered and properly litigated!

Should Trump concede even though legal challenges are being made?

No!

In researching this issue, I discovered that if he concedes it opens up taxpayer money to the Biden/Harris camp. This is money for the President-elect to use for transition purposes and is perfectly legit. But other than the media crowning of Biden/Harris as President-Elect there is no President-Elect yet. That remains to be seen and won’t be known until around December 14, 2020 when the Electoral College votes are tabulated or more accurately January 6, 2021.

However, to answer the question if Biden/Harris is certified as President-Elect then President Trump should concede. But the current recounts are seeing the gap between Trump and Biden/Harris narrowing. With the outstanding votes yet to be recounted there is a strong possibility that the battleground states, at least some of them, will turn red. So, he is wise in waiting right now.

What is Congress’s Role?

On January 6, 2021 Congress meets to certify the election results. This will be a joint session involving both the House of Representatives and the Senate. From what I have been able to find it is pretty cut and dried. This is the final and official certification of the election.

What will I Do if Biden/Harris win?

You may have noticed that I continually use Biden/Harris throughout this blog. That is because I do not expect that Joe Biden will be President very long if he is elected. I sincerely doubt he will last the first year let alone the full term. Pelosi and company may give him the first 100 days, but they are biting at the bit to get Kamala Harris into office through the 25th amendment.

Therefore, if Trump loses, I will identify the President-Elect as Biden/Harris. She is also the power behind Biden. He takes his cue from the far left as long as he can remember what he’s supposed to say. I am 77, about the same age as Biden, and sometimes forget things. Even though it is not constant like his, I would not be fit for such a high office.

But we’ve all seen him stumble. He forgets where he is and who he’s talking to and that would be disastrous for a President. Moreover, the President can’t hide in his basement. By the nature of the office he is very public. Every word, every action, and even the way they dress is analyzed more than any other government office. I doubt Joe Biden could stand up under that kind of scrutiny.

Riddle News: Certified?

Welcome to Riddle News which is published every Monday and Friday. This is a Special review of the 2020 election.

Claim: Election goes to Pelosi controlled House within days of election.

As with anything there are always facts that have to be dealt with. The next step in the election is quite often called certification. Votes need to be verified and counted. Let’s take a closer look.

State certification.

Each state has their own laws and state constitutional requirements. These can vary from as couple days after the election to weeks and even into December. During this time all the ballots will be counted and verified. Verification usually means checking the postmark (if a mail-in), proper signature, proper marking of ballot, and eligibility (i.e., is the person a registered voter in the particular state).

However, legal challenges can impact the process. And it is safe to say there will be legal challenges. I believe some have already been filed.

 Because of Covid-19 the process is further messed up. Some states mailed out ballots to people irrespective of whether they asked for one or not. This raises serious mail fraud questions that will likely have to be settled in court.

But the counting of ballots is not the whole story.

Electoral College

Contrary to liberal thought, the President is not elected by popular vote. Within a state, yes. But each state has Electoral College electors. The number of electors differs by state and often are chosen by the parties. The winning party’s list of electors would then be chosen.

These electors then meet and vote for the President. In theory they vote according to the popular vote count, but it is possible to vote for someone else. The U.S. constitution does not require electors to vote according to their state’s popular vote. On the other hand, some state’s have laws binding the elector’s to vote as they ‘pledged’. (Pledged simply means if they are part of the Republican electoral list they will vote for the Republican, and if on the Democratic list they will vote for the Democrat.)

NARA

NARA (National Archives and Records Administration) is an independent government agency responsible for preserving historical records. In a national election they are also responsible for transmitting the electors (Electoral College) votes to Congress where they will be counted. Electors cast their votes on December 14, while Congress counts the votes and declares a winner on January 6th.

Congress

On January 6th Congress will convene and the votes will be counted state by state. In the end there will be a final tally and the President will be announced. There is the possibility of a tie, but I am not going into that.

Lawsuits

This is a long drawn out process. And because of lawsuits it will be more drawn out. But when you have evidence indicating voter fraud (and it certainly appears so) then the legal challenges must go forward.

Elections are serious business and when an individual, a group of individuals, or a party attempts to ensure their candidates election by suppressing votes or adding votes it requires a legal investigation.

Are There Instances of Voter Fraud?

Don’t expect an honest answer from the media. But, yes, there have been reports of improper actions to suppress or alter votes. One such accusation involved certified vote watchers being denied the ability to watch the count in disregard to a court order. I wasn’t there and didn’t see it, but such accusations deserve to be explored by a legal authority (i.e., court).

Also, the practice of some states to send out ballots to all people living within their states, regardless of whether they were citizens or not, or registered voters is reprehensible and needs to be investigated.

Supreme Court

Yes, it is possible this will go to the Supreme Court. In fact, I will go so far as to say it is likely. Assuming we now have a court that esteems the Constitution, then I welcome it.

Harris’s falsehood about President Lincoln

By now everyone knows that Vice President Pence won his debate with Kamala Harris hands down. But I want to address Harris’s rebuttal during the debate concerning the nominating of a new Supreme Court Justice.

When the subject came up, she chose to be a teacher and proceeded to tell all of us that President Abraham Lincoln refused to nominate a Supreme Court Justice prior to the election.

“In 1864 … Abraham Lincoln was up for reelection. And it was 27 days before the election. And a seat became open on the United States Supreme Court. Abraham Lincoln’s party was in charge not only of the White House but the Senate. But Honest Abe said, ‘It’s not the right thing to do. The American people deserve to make the decision about who will be the next president of the United States, and then that person will be able to select who will serve on the highest court of the land.” Kamala Harris

While it is true that Lincoln refused to nominate a Supreme Court Justice it is not true that he did so because of a principle such as she said.

Let’s take a journey back in time to 1864:

  • No evidence that Lincoln ever made comments she attributed to him
  • Lincoln’s Party usually refers to Republican Party
  • Lincoln was running on National Union Party ticket, not Republican
  • Democrat Andrew Johnson was running as Vice President
  • A little fracas history called the Civil War was taking place
  • Congress was in recess
  • Congress wouldn’t reconvene until December 5, 1864
  • Even if congress reconvened distance and transportation made it virtually impossible
  • Fastest transportation was coal-burning train
  • Senators were at home far from Washington D.C.
  • Communications in 1864: Limited primarily to city folk
  • Communications in 1864: No phone, no TV, no Radio
  • Communications in 1864: Telegraph was costly, slow, with abbreviated messages
  • Communications in 1864: Newspapers usually a month old, not detailed, no pictures

What I found interesting was that even liberal Fact Checkers labeled her comments as False! That tells you something. When I saw and heard her remarks, I felt that it was a prepared comment, but if that were so, then she was ill prepared. And putting words into the mouth of any President, let along President Lincoln, is not only ethically wrong, it comes off as a lie!

Disrupt Business as Usual

Once again, the Democrats think Americans are stupid. Earlier they had pledged to disrupt the nomination of Barrett for Supreme Court. According to reports only one Democratic Senator was in the Senate while others stood outside. This was an attempt to force Senate Majority Leader Mitch McConnell to ignore Senate Rules concerning Minority Party presence (two Senators required).

However, I believe they failed. Why? Read the following:

  • Senator Richard Blumenthal (D) of Connecticut, walked in and voted “no” during vote
  • Other Democrats voted by proxy

In other words, they were present, some hiding out in the halls until the vote began; then Blumenthal entered the chamber. There were at least two physically present and the rest were present through modern communications. The entire episode was staged to send a message to the American people that the process was flawed.

Instead, they sent a message to the American people that their concern for propriety was and is fake. And, in my opinion, most Americans saw it that way. Just as the Democrats never had a viable issue with President Trump but impeached him anyway, here they are using childish pranks to get their way. It is a disgrace.

As an aside, as a young man I saw a lot of differences between Republicans and Democrats, but men and women of both parties were willing to cross the aisle to come to an agreement on legislation. Those days seem to be loooong gone!

It’s the Economy

With all the talk about Covid-19 cases rising, the media doesn’t mention that the Death Rate is still going down. The latest rate is about 2.7%. Neither are they talking about the resurgent economy.

The painting of a dour future by the media serves their leftist agenda, but the fact is that the economy is coming back. Below are some of the positive highlights (all in September):

  • Construction industry added 26,000 jobs
  • Financial Activities added 37,000 jobs
  • Health Care and Social Assistance added 108,000 jobs
  • Manufacturing added 66,000 job
  • Other Services added 27,000 jobs
  • Professional and Business Services added 89,000 jobs
  • Retail Trade added 142,000 jobs
  • Unemployed people fell 1,000,000
  • Unemployment Rate fell to 7.9%
  • Wholesale Trade added 19,000 jobs

It is time for us to focus on the economy. Covid-19 as a deadly force is declining despite the current talk about a second and third wave. But the economy is getting stronger not only by the month but by the week!

Welcome to Ron’s Lit Tip. Every Tuesday, Wednesday, and Thursday I will share a tip with you.

Last night I watched the debate between President Donald Trump and former Vice President Joe Biden. I decided to report on that instead of my normal lit tip.

The debate was a disaster in many ways, but I did draw a few things from it.

  1. Classic Trump

The President is combative. That is not a news flash, we all know it. And last night he was very combative. He won’t and wasn’t silent when he felt Biden was lying. He interrupted Biden frequently and dominated the debate.

  • Joe Biden

Joe had memorized certain words and phrases prior to the debate. This showed up several times. He used the following, “he doesn’t know what he’s talking about,” “he’s a liar,” “a clown,” plus the laugh. All of these were put out there hoping that one of them was a virile sound bite. The laugh was designed for video.

But for all intents and purposes these failed. What I remember the most from the debate was that Biden was ineffective, at times he fumbled his words, his lips quivered, and some people noticed stressed facial expressions, all of which indicated that Joe Biden was having cognitive troubles.

But of more concern to me was he couldn’t handle the attacks from President Trump. He had to know that the attacks were coming, and his only response was to mumble words and phrases he had memorized. In one instance, he seemed to need the moderator, Chris Wallace, to help him.

It occurred to me that if Joe Biden couldn’t handle a debate where he knew attacks were coming, how could he expect to handle the pressure of the Presidency?

  • Chris Wallace

Wallace is Center Left, a liberal who doesn’t like Trump. So, it wasn’t surprising that his overall performance favored Biden. Although both candidates ignored the agreed upon rules and interrupted one another, Wallace appeared to give Biden more leeway.

  • Fact Checkers

I have little confidence in factcheckers, so I didn’t watch them. This morning I looked at a couple to see what they were saying. Basically, they were predictable.

  • Overall

I remember a time when debates revealed information that proved important to the election. Last night’s debate revealed little. There are a few items though.

Court Packing – There has been talk that if the Senate confirms Trump’s nominee for the Supreme Court and if Biden wins, he will try to pack the court. In other words, increase the number of judges. This only requires a Congressional act signed into law by the President. Biden refused to answer the question by Wallace if he supported packing the court.

Economy – Simply put, President Trump favors opening up businesses, schools, etc., while Biden supports shutting everything down. I find Biden’s leanings amusing to a degree. He continually referred to Trump’s shutdown as a “recession.”

Jobs –Biden and Wallace both cited the number of jobs Obama created as opposed to the number of jobs Trump has created. The problem with that is that the Obama jobs were low paying (think McDonalds) while the jobs under Trump have been increased factory jobs, higher paying white collar jobs, and the return of many white collar employees to or near the pay levels of prior to 2008.

Who won? That’s easy. Trump 1, Biden 0.

What’s all this noise about the Supreme Court?

With the death off Justice Ruth Bader Ginsburg a major shift is in the wind for the Supreme Court. Because of this the Left and Right are squaring off. For the Democrats it represents what might be a distant prospect of changing the judicial landscape solidly to the Left. For the Republicans it represents the opportunity to finally shift the court to the right where the Constitution and rule of law outweigh social experimentation.

The current battle is whether a justice should be nominated by President Trump or by the next president (Trump or Biden).

Who’s Right?

That depends on your worldview. If you are on the left and are hoping Biden wins then you want to delay the nomination until Biden is in office. If you are on the Right, you want the nomination now for at least two reasons.

The first reason is that if the election is close, like some prognosticators think, then it could be decided by the court. In that scenario you need a full Supreme Court bench. Otherwise, you get a real mess.

The second reason is that the court would be returned to its original status, namely, a court ruled by the Constitution. Not the modernized constitution of the Liberals but the Constitution that is the foundation of American.

What Happens if Trump’s Nominee Fails to Win in Senate?

Not much. It only delays it if Trump is re-elected. I believe he will be re-elected, but if not, then Biden would have the choice.

Doesn’t Trump trail in the Polls?

In some he still trails, but in polls based on “Likely” voters he is winning, and the margin has been increasing. There has been a shift toward Trump in the Battleground States and among the Hispanics and perhaps the Black communities.

Another factor to consider is the influence of the Internet. In the past the Democrats would use all manner of deception and confuse, even deceive, the American public. But things have changed. Americans of every age, color, and ethnicity are proficient with the Internet and know how to look up the facts. Many, if not most, understand that so-called “Fact Checkers” are unreliable and biased.

So, they look the information up and find out the truth.

So, what can we expect?

As far as the Supreme Court is concerned it is hard to tell. But despite House Speaker’s Pelosi’s claim she has something up her sleeve it is doubtful there is anything there. The real question is whether the Republicans will stand with the President. Time will tell.

As for the election, I think Trump benefits no matter which way the Senate goes. And I think he will be re-elected perhaps in a landslide.

Where does Harris stand on the Issues?

Abortion

  • Pro-Choice
  • Supports preventing states from enacting laws without first clearing with Justice Department
  • Supports repeal of Hyde Amendment

(Pro-Choice, a feel good name for Pro Abortion, is now accepting abortion right up until birth.)

Climate Change

  • Supports giving grants to coastal communities to prepare for sea-level rise
  • Supports the Green New Deal

(The Green New Deal is a prescription for disaster. Major industries, including mom/pop businesses would be negatively impacted. It could reduce America to a 3rd world country.)

Criminal Justice Reform

  • Opposes death penalty (formerly supported it)
  • Supported pardoning people convicted of drug-related crimes
  • Supports expanding (packing) the Supreme Court

(The death penalty is 100% effective against repeat offenses; pardoning drug-related crimes would flood streets with criminals; packing Supreme Court would undermine government.)

Economy

Allegations

Monday through Friday I deal with different subjects in this blog. I also post my blog to my Facebook page at RFrederickRiddlesWorld. Monday’s I try to focus on issues. This week I am taking a look at Allegations.
Now that Kavanaugh has been confirmed I want to take a closer look at the allegations; in particular, Dr. Ford’s allegation. Below I have included a Letter to the Editor written by a person who seems very well informed. It makes interesting reading and can explain how two people can have totally different memories and both be “credible.”
Here it is:
Two good people, how can this be?
“Most of us like to believe we can determine who is trying to mislead us. However, there are occasions where we admit our failure. Both are ethical and honest; how can we understand what happened?
I believe the answer lies in the history of memory recall. Most of us remember the agony of having children claim their parents abused them, a teacher tortured them, and so forth. They were believable because they really thought it happened, they were not lying. This was a false memory.
“Investigators know that a witness to a crime may be misled by a suggestion made during an interview that may cause them to really recall a happening that never actually did. Following the “false memory” issues we learned that during therapy, suggestions made by the therapist, in their building a patient’s history, will ask about childhood trauma.
“The above issues were resolved by investigation into the claims. If people named fail to confirm it, and it appears the event never took place, we call this a false allegation.
During the 1980s families and reputations were destroyed by prosecutors and investigators who believed it had to happen because the claimant was so sure it took place. Are we again failing to learn from the past and destroying reputations? Dr. Ford is a person who recalled an event while in therapy. The three witnesses she offered all said she was mistaken. In a normal world this would be listed as a false allegation by a well-meaning person.” (Emphasis added.)
Amidst all the charges and countercharges, amongst all the anger, and amongst all the self righteous manipulations by the Democrats two people were torn apart. Judge Kavanaugh denied and offered credible proof of his denial; Dr. Ford remembered but had no credible proof. Perhaps it is not that she lied but as pointed out in the above letter, she had a false memory. A memory she really believes happened though it never did!
So who’s to blame for all this?
I think we have to look no further that Senator Feinstein. As it looks right now she never checked out the allegation. She saw an opportunity to stop the nomination, sat on the allegation, and revealed it without Ford’s permission at the last moment. The very least she should have done is turn everything over to the committee as soon as she got it and sought clarification. Or, as facts now show, if not confirmed or verified, keep it confidential and do nothing else with it.
The Left has made a big mistake!
Not only did the senator drop the ball, the Left, whether Democrats or George Soros, showed how far from the mainstream they have really gone. There are good people who favor the politics of the left that have been betrayed. The good people who believe a person is innocent until proven guilty have been betrayed. The institution of government has been betrayed. The confidence of men and women who might want to run for office has been betrayed. And most important, the American people of all persuasions have been betrayed.
And for what? To protect their agenda!
Will the American voters remember come November?

Today’s Issue: Need for a Constitutionalist
Monday’s I try to focus on issues. This week I am taking a look at the nomination of Brett Kavanaugh for Supreme Court Justice.
There are a lot of side issues in this nomination with the democrats acting like spoiled babies. Even today I saw an article that indirectly attacked Kavanaugh though it was aimed at the GOP. The author of the article made a big issue about whether the nominee was likable. Claims that the GOP thinks he should receive Senate approval simply because he’s a nice guy. Actually I don’t know of any senator who would ever make that claim.
But the writer missed the most important issue: The View of the Constitution.
When selecting a person to be on the Supreme Court, we all want our favorite politics represented. Democrats generally want a liberal and Republicans generally want a conservative, but that doesn’t tell us of the person’s view of the Constitution.
Unfortunately there are elitists who believe they know better about what is good for Americans. They can be either Democrat or Republican or any other party. These same people view the constitution as a living document. To some extent so do I, but not as they do. They consider it a living document that can be interpreted according to the times we live in.
My view is that the constitution is a living document because it can be amended. When the constitution was first written there was opposition to it because it failed to protect certain perceived rights. Thus, it was amended.
And throughout our nation’s history there have been times when the constitution has been amended through the constitutional mechanism. That is the right and proper way of making the constitution viable for our generation and future generations.
But in matters of law and governance the constitution is the absolute authority.
It is not up to an activist judge, whether liberal or conservative, to twist the constitution to his/her opinion. It was meant that the judges up to and including Supreme Court judges protect and enforce the constitution. This requires a strict adherence to the constitution. No opinion, no outside document, and no circumstance should ever hold sway in contrast to the constitution. It is the absolute authority.
But what about our rights?
When black men and women’s rights needed protection an amendment was passed; when women’s rights were threatened an amendment was passed; and when other rights were threatened specific amendments were passed. These are time consuming avenues that are meant to allow a thorough examination of the issues before a vote. It is meant that the American people not elitists in Washington D.C. determine what is needed.
The Supreme Court needs Constitutionalists.
Judge Kavanaugh has a career resume that demonstrates that he takes a literal view of the constitution. If this causes him to vote conservative most of the time then so be it, although I’d bet that sometimes we conservatives will not like his vote. Why? Because we conservatives don’t always stick to the constitution either.
We don’t need Activist Judges.
By definition an activist judge is not a constitutionalist. Whether liberal (usually) or conservative (sometimes) they tend to bend the constitution and the law to fit their own bias. I think Americans are getting sick and tired of that.
We need men and women who will stick by the constitution and by the law. And if the constitution or the law needs changed, follow the constitutional mechanisms provided! This approach served our country well for its first 100 years and then we started getting cute with our interpretations. And look at the mess we have!
That is the criteria for selecting a jurist for the Supreme Court. Not the person’s likeability, not the person’s sex, and not the Senate’s political bias’s. The Senate is suppose to determine if the nominee fulfills the Constitutional requirements not the current politically correct view. If they’d do that the entire process would not take nearly as long as it probably will take.
Based on what I’ve heard and read, Brett Kavanaugh deserves Senate approval.
